Although still relatively unexplored in France, research in Law and Management is of major interest. It serves the dual purpose of better understanding how legal rules influence the performance of organizations, their strategies, and management methods, on the one hand, and providing quantitative and qualitative analyses of the impact of managerial practices on the law, on the other.
The field of Law and Management research
At the heart of the field of Law and Management research are necessarily observed networks or "nodes" of contracts, issues of governance and the responsibilities of legal entities and their managers, as well as individual and collective labor relations and geopolitical issues of economic exchanges with suppliers and customers. This vast field is therefore an ideal arena for observing how companies, large and small, use legal instruments (most often soft law) to structure their activities and manage risks in order to avoid sanctions or even turn them into a strategic resource.
This aspect of private law is naturally governed by public law rules on public procurement, public-private partnerships and, increasingly, the ecological transition. Environmental standards are prompting organizations to rethink their governance, as well as their human resources and risk management. More recently, the emergence of new technologies has directly challenged the role of law with regard to the automation of business processes, the decentralization of governance, and the restructuring of organizational models into potential "commons" (decentralized and non-state), halfway between public and private law.
New areas of research in Law and Management
Current socio-economic transformations are giving rise to new areas of study for research in Law and Management. Companies must internalize new environmental, compliance, governance, and transparency requirements, which are becoming more complex in the context of globalized value chains and, at the same time, tend to favor short supply chains.
Another aspect of current transformations is the rise of technological innovations. AI and distributed ledgers such as blockchain technologies are redefining control architectures in organizations, decision-making processes, and, consequently, the distribution of responsibilities. At the same time, governments are experimenting with the use of such techniques to certify data, secure procedures, and strengthen confidence in public action.
The structure of Law and Management research and its practical implications
Research in Law and Management is still under development, making it a particularly fertile field for research. While pioneering work emerged in the United States in the 2000s, particularly in the area of corporate governance, the field of analysis is expanding in line with rapid developments related to the ecological transition, the digitization of work, and the rise of decentralized management methods. The interdisciplinary, evolving, and socially strategic nature of Law and Management research makes this field a very promising area for original, high-level, and high-impact research.
